Abstract:
Foley & Lardner hosted an exclusive “webinar” on the controversial U.S. Patent & Trademark Office (USPTO) rules that will—to the extent they survive a court challenge—dramatically affect how patent applications are filed and prosecuted in the United States. The webinar featured USPTO Director John W. Dudas, USPTO Senior Patent Counsel Robert Bahr, and a panel of Foley attorneys including Steve Maebius, Courtenay Brinckerhoff, and Steve Fox (former chief patent counsel at Hewlett-Packard). The following article explains how the new USPTO rules will impact the nanotechnology sector and presents practical strategies for nanotech companies to consider when grappling with this new patent system.
