Abstract:
“Quantum Dot” technology involves nanomolecules that can be tuned to emit specific frequencies. The dots are molecule-sized semiconducting nanocrystals, generally composed of heavy metals surrounded by an organic shell. They have the potential to enable efficient solar power, targeted gene and drug delivery, solid-state lighting, and advances in biomedical imaging. Recently, there have been two lawsuits brought on patents covering this technology: Invitrogen and Nanosys cases. Although neither lawsuit culminated in a trial, or even a claim construction hearing, these cases—as well as other industry-wide considerations such as environmental concerns—may foreshadow the beginning of a new field of nano-litigation.
