Abstract:
Any company considering the importation or manufacture of nanoparticles needs to be aware of how nanoparticles are regulated by the EPA under the authority of the Toxic Substances Control Act. Difficulty in nanoparticle classification makes navigating EPA regulatory hurdles such as premanufacture notices, significant new use rules, and consent orders unique. Recent decisions, rules, and expected policy changes by the EPA are discussed, including recent actions regarding carbon nanotubes.
