Nanotechnology Meets Chinese Herbal Medicine: An Introduction to the Patenting of Nano-Based Chinese Herbal Medicine in Taiwan

Combining nanotechnology and Chinese Herbal Medicine can bring new life to this traditional medicine as well as offer more therapeutic options to patients’ worldwide. Taiwan, which is aiming to prosper by building up the nano-based CHM industry, must adequately protect the creative effort while safeguarding the public interest. Since this industry is still nascent, patent standards should be scrutinized to avoid grating early inventor’s overbroad patent rights. Using the U.S. patent jurisprudence as a reference, this article draws a guideline for Taiwan.
