Micro or Nano? Patenting Opportunities and Challenges for Chinese Herbal Medicine Product Inventions

The advances in ultra-micro powder and nanotechnology have brought a new wave of interest to the modernization of Chinese Herbal Medicine (CHM). This paper suggests that CHM product inventions under ultra-micro powder technology will be less patentable than nano CHM product inventions. However, nano CHM also possesses several unique patenting issues. Using U.S. and Taiwan patent jurisprudence, this paper looks into some of the patent applications in China to identify the patentability issues and to provide recommendations to overcome these obstacles.
