Abstract:
The paper is an attempt to explore the emerging issues and challenges in the field of nanotechnology innovation in India. It examines the role of intellectual property rights and the various areas in nanotechnology to which Intellectual Property (IP) rights are applicable and focused on the applicability of the patent provisions of the Agreement on Trade Related Aspects of Intellectual Property Rights (TRIPS Agreement) in the field of nanotechnology. It presents the issues related to the science of nanotechnology and the challenges surrounding the acquisition of IP rights. The paper also analyses the patenting activity in US patent office and their technology classes and sub-class of 977 to the nanotechnology. These all indicators provide an opportunity for the commercialization of products and process to the emerging field of nanotechnology. The paper is based on information and data gathered through secondary sources from various websites, annual report in the field of nanotechnology.
